TERMS AND CONDITIONS OF SERVICE

1. SCOPE AND APPLICABILITY
These Terms and Conditions apply to all clients worldwide purchasing online consulting and professional coaching services from Albina Temisheva,
VAT 07381940480 , registered office at Via Primo Maggio 52, Florence, Italy (hereinafter "Provider").
Important: Specific provisions in sections 7 and 9 apply differently based on your location. Please read carefully.
2. SERVICE DESCRIPTIONServices include:
- Individual consultation sessions (30 or 60 minutes)
- iWAM test with results analysis
- Career guidance consultations
3. BOOKING AND PAYMENTBookings are made through the website with advance payment. The contract is concluded upon email confirmation of the booking. All prices are stated in euro and are final.
4. RESCHEDULING AND CANCELLATION POLICY
Rescheduling: You may reschedule your session independently
via the link in the booking confirmation email, with at least 24 hours' notice.
Late cancellation or no-show:- Late arrival (more than 20 minutes): the session is considered completed
- No-show without cancellation/rescheduling: the session is considered confirmed and the amount is non-refundable
- If unable to modify the booking independently, contact hello@dtmymonday.com within 24 hours before the session
No refunds are provided for cancellations made less than 24 hours before the scheduled session or for no-shows.
5. SESSION CONDUCTSessions are conducted online via video conferencing platform.
You must ensure:
- Stable internet connection
- Private, quiet environment
- Working camera and microphone
Provider is not responsible for interruptions, delays, or inability to complete sessions due to your technical issues, internet connectivity problems, or force majeure events.
6. NATURE OF COACHING SERVICEProfessional coaching services
do not constitute psychotherapy, psychological treatment, medical advice, legal counsel, or financial advice. Coaching is a collaborative, goal-oriented process focused on professional development.
You acknowledge and agree that:- You are solely responsible for your own choices, actions, and results
- Provider makes no guarantees or warranties regarding specific outcomes
- Coaching requires your active participation, honesty, and willingness to change
- You are mentally and physically capable of participating in coaching
- You will seek appropriate professional help (medical, legal, financial, therapeutic) when needed
7. REFUND AND WITHDRAWAL POLICY 7.1 For Clients Residing in the European UnionUnder Italian Legislative Decree 206/2005 (Consumer Code) and EU Directive 2011/83/EU, you have the right to withdraw from this contract within 14 days of purchase without giving any reason.
To exercise your withdrawal right, send clear written notice to
hello@dtmymonday.com within 14 days.
Waiver of withdrawal right: If you request that the service begins within the 14-day withdrawal period, you expressly agree that:
- You are requesting immediate performance of the service
- You waive your right of withdrawal once the service is fully performed
- If the service is performed before the 14-day period expires, you will not be entitled to a refund
7.2 For Clients Outside the European UnionFor clients residing outside the EU, the following applies:
No refund policy: All sales are final. No refunds will be provided except:
- Technical failure by Provider preventing service delivery
- Provider cancellation of scheduled session
Cancellation by Provider: If Provider cancels a session, you will receive a full refund or option to reschedule at no additional cost.
8. CONFIDENTIALITYProvider maintains confidentiality of all information you share during sessions, except:
- Where required by law or court order
- Where you provide written consent
- Where necessary to prevent serious harm
Sessions are not recorded without your explicit written consent. Any materials shared remain your property unless otherwise agreed.
9. LIABILITY AND DISCLAIMERS
Limitation of liability: To the maximum extent permitted by law, Provider's total liability for any claims arising from these Terms or the services shall not exceed the amount you paid for the specific session giving rise to the claim.
Provider is not liable for:
- Indirect, incidental, consequential, or punitive damages
- Lost profits, data, or business opportunities
- Actions you take based on coaching sessions
- Technical issues beyond Provider's reasonable control
No professional liability: Coaching is not a regulated profession in Italy. Provider does not carry professional liability insurance for coaching services.
10. DATA PROTECTION AND PRIVACYPersonal data is processed in accordance with:
- EU General Data Protection Regulation (GDPR) - Reg. 2016/679
- Italian Legislative Decree 196/2003 (Privacy Code)

International data transfers: If you are outside the EU, your data may be transferred to and processed in Italy/EU under appropriate safeguards.
11. INTELLECTUAL PROPERTYAll materials, content, methodologies, and tools provided by Provider (including iWAM test materials) remain the exclusive property of Provider or its licensors. You may not reproduce, distribute, or create derivative works without written permission.
12. DISPUTE RESOLUTION 12.1 For EU Clients
Applicable Law: These Terms are governed by Italian law.
Jurisdiction: For disputes with consumers residing in the EU, the competent court is that of your habitual residence.
Online Dispute Resolution: EU consumers may access the ODR platform at
https://ec.europa.eu/consumers/odr12.2 For Non-EU Clients
Applicable Law: These Terms are governed by Italian law, excluding conflict of law provisions.
Arbitration: Any dispute arising from these Terms shall be resolved through binding arbitration in accordance with the Rules of Arbitration of the International Chamber of Commerce (ICC). The arbitration shall be conducted in English in Florence, Italy, by a single arbitrator.
Exception: Either party may seek injunctive relief in any court of competent jurisdiction to prevent infringement of intellectual property rights.
Class Action Waiver: You agree to resolve disputes on an individual basis and waive any right to participate in class actions or representative proceedings.
13. FORCE MAJEUREProvider is not liable for failure to perform obligations due to circumstances beyond reasonable control, including natural disasters, war, terrorism, pandemics, internet outages, or government actions.
14. SEVERABILITYIf any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in full force and effect.
15. ENTIRE AGREEMENTThese Terms constitute the entire agreement between you and Provider regarding the services and supersede all prior communications and proposals.
16. AMENDMENTSProvider reserves the right to modify these Terms at any time. Changes will be communicated via email to clients with existing bookings. Amendments do not apply to services already purchased. Continued use of services after notice constitutes acceptance of modified Terms.

- You agree to be bound by these Terms
- You are at least 18 years of age
- You have the legal capacity to enter into this contract
- All information provided is accurate and complete
- You understand the nature and limitations of coaching services
- You consent to the immediate performance of services (EU clients: waiving withdrawal right)
